hearing and certified that public notice was published in the Boulder Camera on February 21,
1999, which included the ordinance and the full map and was posted in City Hall

Staff Report and Facts and Issues:

Ken Johnstone stated that a discussion point brought up at the last City Council meeting
suggested that it might not be appropriate to treat the commercial property on both sides of the
railroad tracks in the same manner. Council did direct the Staff and the Planning Commission to
consider that point as to whether the Design Handbooks, the F.A.R. Ordinance and the Parking
Regulations should apply equally on both sides of the tracks. Mr. Johnstone presented the details
of this matter as stated in the staff report.

Commission Questions/Comments:

Commissioner Lipton asked if this is not incorporated, what guidelines would they be under? Ken
Johnstone stated that they would be under the CDDSG would apply and that the 29-foot height
ordinance would apply to the CC district and parking regulations would come out of the CDDSG
as well as design regulations.

Commissioner Lipton feels that the east side of the tracks will developed later and that there is a
strong desire to do some three-story buildings in the downtown area and wonders if that side of
the tracks wouldn’t be a bad place to designate that type of development.

Chairman Boulet agrees that this is an opportunity to integrate that gateway and would like to see
the right standards of development for it.

Commissioner Pritchard is concerned about the parking issues and that some people will start to
tear down buildings in order to meet the parking requirements.

Commissioner Solek agrees that it is important to apply the Design Guidelines to both sides of the
track.

Staff Summary:

Mr. Johnstone commented on the Downtown Design Handbook which is proposed to be adopted
as an amendment to the zoning code. It would be an appendix to the zoning code and there are
also some changes to the PUD Ordinance that would reference the Design Handbook. The
Design Handbook would supercede zoning regulations to the extent that if there were a conflict,
this would be the controlling document.

Commission Comments

Chairman Boulet feels that this document has tremendous merit.

2
