way the staff recommendation is worded they would be looking for something from an engineer
that states that there should be no restrictions on the property of Outlot A.

Mr. Johnstone stated that this is a two-step process. At the same time that this would be passed
there is a separate ordinance pending that would establish two new areas and appropriate
restrictions around those. For the two new locations for the mine shafts there would be
established a new hazard area where certain limitations would be placed.

Mr. Lee stated that in Outlot A right now a corner of a building comes into it. Outlot A right
now says that’s its only for landscaping and parking because of the mines. Because the mines are
not there, they are in another place, it’s time to remove this area so that a building can go in that
area.

Mr. Johnstone stated that was correct and that is why the statement of no restrictions needs to go
in.

Public Hearing closed/Motion:

Motion made by Commissioner Klahn to approve Resolution No. 38, Series 1999, as written,
with the condition; that the applicant provide further evidence from a Colorado licensed engineer
that it is acceptable to fully remove the geologic hazard designation and that no restrictions are
required within Outlot A. Seconded by Commissioner Pritchard.

Roll Call Vote:
Jeff Lipton, Yes; Patricia Thompson, Yes; Sarah Klahn, Yes; Chris
Pritchard,Yes; Bill Boulet, Yes. Motion passed 5:0.

Staff Comments:

Mr. Johnstone stated that Staff is finished with the text modifications of the Industrial Design
Guidelines and they should be distributed to the steering committees review this week. Staff will
also be working with the architectural members of the steering committee on developing the
graphics and support illustrations that go with the text. The final meeting should be on August
26, and Planning Commission meetings in late September.

Commission Comments:

Commissioner Pritchard asked if someone would contact Conoco regarding the dying trees on
their property.

Adjournment:

Meeting adjourned.

11
