Paul Wood, Planning Director and case <br />manager stated that full public notice was published in the Boulder Daily Camera on December <br />29, 2002 and posted in City Hall and mailed to the adjacent property owners on December 24, <br />2002. <br /> <br />Staff Report of Facts and Issues: <br />Wood reported that the property owners, James S. Ray and Christina Dozauer-Ray, have <br />submitted an annexation petition to commence the annexation process for a parcel located at 100 <br />W. Spruce St. The parcel is approximately 24,472 SF in area, of which approximately 7,986 SF is <br />located within the Spruce St. right-of-way. A single-family residence occupies the property. <br /> <br />Wood stated that the owners are requesting a single family – medium density (SF-MD) zoning. <br />Wood advised the Planning Commission that the request is consistent with the terms of a pre- <br />annexation letter of agreement. He further explained that the letter of agreement was to set out <br />those conditions under which the applicant would be able to purchase a sanitary sewer tap from <br />the City. Having just purchased the unincorporated property, the applicant was being required by <br />Boulder County Land Use, as a condition of building permit issuance. The letter of agreement <br />also required the applicant petition the City for annexation with a zone district of SF-MD. In <br />addition, the letter of agreement states that the owner shall convey a conservation easement to the <br />City.
