<br />Approved – September 18, 2003 <br />They were advised of the need to go through this formal SRU amendment in order for an <br />expanded use of the facility to continue operation. <br /> <br />Staff noted that the expansion into the Fellowship Hall of the United Methodist Church would <br />accommodate up to an additional 15 students ranging in age from 2.5 to 6 years. Staff also noted <br />that the staffing would be up to seven. The request is for a total of 46 students, which if the <br />maximum allowed pursuant to health department and fire code requirements. <br /> <br />Staff clarified that no modifications to the site or to the external operations of the school are being <br />proposed. Parking would remain the same and the drop-off along Jefferson would not change. <br />Staff noted that the play area is adequate in size to accommodate the expanded student <br />population, pursuant to state standards. <br /> <br />The remainder of the staff presentation detailed the special review use criteria. Staff noted that <br />two e-mail messages, included in the staff report, from neighbors on Jefferson Ave to the City had <br />requested a consideration of relocating the drop off location to Spruce Street. Staff <br />acknowledges the legitimacy of the concern expressed by the neighbors. However, Staff also <br />believes that the response from the applicant includes legitimate reasons why it would be difficult <br />for them to use a Spruce Street drop off, and could introduce additional safety concerns for <br />children. From an enforcement perspective, without using dedicated police officers at this <br />location, it also might be difficult to stop parents from dropping off their children in front of the <br />building, which is likely the natural inclination. <br /> <br />Staff finds the proposal to meet the special review use criteria and recommends approval of the <br />amended special review use application with one condition: <br /> <br />1)A total maximum occupancy (at any one time) of 43 students and 5 staff shall be noted on <br />the Amended SRU plan sheet. <br /> <br />Commission Questions: <br />McAvinew: How did Staff learn that they had expanded? <br />Johnstone: The Health Department had requested a zoning clarification letter regarding the recent <br />expansion. <br /> <br />Applicant Presentation: <br />Lee Ryland, 733 Jefferson Ave., Louisville, CO thanked Staff for the thorough staff report and <br />stated she had no additional comments but would answer any questions that the Commissioners <br />might have. <br /> <br />Commission Questions: <br />Scott Robson requested clarification of the enrollment numbers. <br />Johnstone referred the Commissioners to the Staff Report that included an enrollment information <br />sheet for the 2003-2004 academic year. <br /> <br /> <br />3 <br /> <br />
