Susan Loo was not in attendance. <br /> <br /> Resolution No. 6, Series 2003, Meadows at Coal Creek <br />, an amended final PUD <br />development plan to allow a reduction in the rear yard setback from 25 feet to 15 feet <br />which would allow homeowners to install patios and deck shade arbors in the <br />Meadows at Coal Creek Subdivision. Case #02-0280FP. <br /> <br /> <br />Case Manger, Jeffery Martell, Planner II <br /> <br /> <br />Applicant: Meadows at Coal Creek Homeowners Association <br /> <br /> <br />Representative: Michael Reis <br /> <br />Conflict of Interest and Disclosure: <br />Lipton asked the Commissioners to disclosure conflicts of interest. None heard. <br /> <br />Public Notice Certification: <br />Lipton requested of Staff public notice verification. Jeffery Martell, Planner II and case manager <br />stated that full public notice was published in the Boulder Daily Camera on March 23, 2003 and <br />posted in City Hall and mailed to the adjacent property owners on March 21, 2003. <br /> <br />Staff Report of Facts and Issues: <br />Martell explained this is an application for a PUD amendment from the Meadows at Coal Creek <br />Homeowner’s Association (HOA) requesting a reduction in the rear yard setback for covered <br />decks. Specifically, the request is to allow decks above 30”, covered or non-covered, on lots <br />within the subdivision to encroach into the rear yard setback ten (10) feet, where the PUD <br />requires a structure to be set back twenty-five (25) feet. <br /> <br />Martell explained that the property was platted in September 1992 for 102 lots ranging in size <br />from 6,000 SF to 9,000 SF in size. The minimum building setbacks were platted as follows: <br />From front lot line – 20 feet <br /> <br /> <br />From corner right-of-way lines – 20 feet <br /> <br /> <br />From side lot lines – 5 feet <br /> <br /> <br />From rear lot lines – 25 feet <br /> <br /> <br />Maximum building height – 30 feet <br /> <br /> <br /> <br />Martell also explained that Resolution No. 37, Series 1995 amended the PUD setback <br />requirements as follows: <br />Front yard setback – average twenty (20) feet. A minimum of 19 feet, except that for <br /> <br /> <br />a single story home with a front loaded garage, the front setback shall be 16.5 feet; <br />Side loaded garages shall have minimum front setback of 19 feet, except for lots <br /> <br /> <br />greater than 115 feet in depth, a side-loaded garage may have a minimum setback of <br />16 feet. The portion of a garage structure with a setback of less than 19 feet shall be <br />limited to a one-story garage only and not include any other first or second story living <br />area. All construction must conform to required vision clearance areas. <br /> <br /> <br />5 <br /> <br />
