<br />Conflict of interest and disclosures: <br />He asked the Commissioners if they had any conflict of interest or disclosures. <br /> <br />Debra Kalish stated that the law firm that she is employed by had been one of the firms that STK <br />had contacted a year ago regarding these projects. She participated in a meeting with STK and <br />the law firm to review the proposals which did not include any substantive discussion of these <br />current application submittals. However, the law firm was not selected by STK to represent them <br />during this process. She did feel it necessary to disclose that earlier contact with STK and the <br />firm. All the members of the Commission agreed that it did not constitute a conflict of interest <br />and thanked her for the disclosure statement. <br /> <br />Public Notice Verification: <br /> <br />Lipton requested that staff provide the public notification verification. <br />Paul Wood, Planning Director, stated that Public Notice was published in Daily Camera for all <br />three applications on August 31, 2003, posted in City Hall and mailed to the adjacent property <br />owners on August 29, 2003 and September 9, 2003. The two mailing were done because the <br />hearing was rescheduled from September 9 to September 18 and the City felt it necessary to <br />notify the property owners of that change. <br /> <br />Staff Report of Facts and Issues: <br /> <br />Lipton requested that Staff provide the facts and issues related to the case. <br /> <br />Wood requested the input from the Planning Commission regarding the procedure for the Public <br />Hearing of the three STK applications. He suggested that since they were closely related that one <br />staff report be given instead of three. <br /> <br />Lipton queried the Commissioners and they agreed that the staff report should include all three <br />applications in one report. <br /> <br />Wood provided a brief description of the three applications by reading the item as described in the <br />agenda before providing details for each application. He stated that he would review the request <br />for the Comprehensive Plan Amendment first and then follow-up with the zoning and rezoning <br />request. <br /> <br />Case #03-014-CP. <br /> <br />Wood stated that the South Sub-area Plan was originally adopted by City Council in February of <br />1994, and amended twice in 1998. The structure of the document is organized in goals, policies <br />and more specific action items. Elements of the plan include Land Use, Transportation, Parks and <br />Open Space and Urban Design <br /> <br />Wood continued stating that the South Sub-area is approximately 1,800 acres in area and <br />th <br />generally corresponds to properties north of US 36, east of S. 104 St., and south of the Coal <br /> <br />3 <br /> <br />
