The Commission <br />has continued to January 13, January 27 and now February 10, with notices for each hearing <br />being reposted at City Hall and other required locations. <br /> <br />Conflict of Interest and Disclosure: None heard <br /> <br />Staff Report of Facts and Issues: <br />Johnstone provided the following summary: <br /> <br /> <br />The request is for a right of way vacation for a 30-foot by 198-foot piece of land which <br />has been “excepted for road purposes” since the early 1900s. <br /> <br /> <br />It recently came to light based on some surveying work done for the adjacent property <br />owner as well as the Schreiter Slavec Subdivision that the property in question appears to <br />lie to the north of the primary 60-foot Spruce Street road alignment. <br /> <br /> <br />It appears simply that the land was reserved for road purposes based on a surveying error <br />from the early 1900s. <br /> <br /> <br />The full extent of improvements anticipated to be needed for Spruce Street are in place <br />and it does not appear, with a minor exception, that the City will need this additional right <br />of way. <br /> <br /> <br />The exception is an area approximately 5 feet by 60 feet at the southeast corner of the <br />property in question, where the existing sidewalk encroaches slightly into the property. <br />Staff is requesting the additional area to allow room to relocate a fire hydrant to the north <br />of the sidewalk as well as potential utilities and traffic control signs. <br />4 <br /> <br /> <br />
