Boulder County, CO 03244733 2 of 52 <br />require a separate subdivision and/or development agreement for any further subdivision, and/or <br />withhold any building permits for any property within such further subdivision. <br />(b) Takoda and Steel Ranch Apartments each own separate, readily discernable, portions <br />of the real estate comprising the Subdivision, and Takoda and Steel Ranch Apartments <br />acknowledge and agree that this Agreement does not change or alter any prior agreements or <br />obligations between such parties. <br />1.2 Engineering Services. Subject to Section 8.1 below, Subdivider agrees to furnish, at <br />its expense, all necessary engineering services relating to the design and construction of the <br />Subdivision and the Schedule of Improvements described in Exhibit B, attached hereto and <br />incorporated herein by this reference. Said engineering services shall be performed by or under <br />the supervision of a Registered Professional Engineer or Registered Land Surveyor, or other <br />professionals as appropriate, licensed by the State of Colorado, and in accordance with <br />applicable Colorado law; and shall conform to the standards and criteria for public improvements <br />as established and approved by the City as of the date of submittal to the City. <br />1.3 Construction Standards. Subject to Section 8.1, Subdivider shall construct all <br />improvements required by this Agreement, and any other improvements constructed in relation <br />to the Subdivision, in accordance with plans and specifications approved in writing by the City, <br />and with the approved -Plat, Final Development Plan ( "Plan"), and the General Development <br />Plan ( "GDP ") for the Subdivision, and in full conformity with the City's construction <br />specifications applicable at the time of construction plan approval. City approval of construction <br />plans for the Subdivision will be granted only after receipt of the required Improvement <br />Guarantee, and will continue in effect for three (3) years from the date of such approval. In the <br />event that Subdivider commences or performs any construction work on such approved plans <br />after such three (3) year period, Subdivider shall resubmit the subject construction plans to the <br />City for reexamination for compliance with standards and criteria for public improvements in <br />effect for the City as of the date of such reexamination.
