R E S O L U T I O N <br />WHEREAS, the Town of Louisville, now City of Louisville, is one of <br />the defendants in Civil Action No. 7770 in the United States District Court <br />for the District of Colorado entitled "The Aetna Casualty and Surety Co., <br />of Hartford, Connecticut, an insurance company, Plaintiff, vs. Shawnee <br />Construction Co„ Inc. et al„ Defendants," and <br />WHEREAS, Shawnee Construction Co., Inc, filed a cross claim against <br />the Town of Louisville and the Town of Louisville filed a cross claim against <br />Black and Company, now Shawnee Construction Co. , Inc, and a counterclaim <br />against the Plaintiff, The Aetna Casualty and Surety Co, and <br />WHEREAS, Paul A. Morris of the law firm of Dolan & Dolan did represent <br />the City of Louisville at a hearing held in the United States District Court <br />for the District of Colorado, William E. Doyle, Judge, on June 21, 1963, at <br />the hour of 1;30 P.M, and did then and there stipulate to dismiss with <br />prejudice the City of Louisville's claims against The Aetna Casualty and <br />Surety Co, and Shawnee Construction Co., Inc, and <br />WHEREAS, The Aetna Casualty and Surety Co., by its counsel, John P. <br />Akolt, did stipulate to dismiss with prejudice its claim against the City <br />of Louisville and Shawnee Construction Co., Inc, by its counsel, William <br />A. Trine, did stipulate to dismiss with prejudice its claim against the <br />City of Louisville, <br />NOW, THEREFORE, be it resolved by the City Council of the City of <br />Louisville, Colorado; <br />That the above described acts by Paul A. Morris on the behalf <br />of the City of Louisville are hereby ratified, approved and accepted <br />as the act of the City Council of the City of Louisville. <br />ADOPTED this day of July, 1963, at Louisville, Colorado. <br />Mayon <br />ATTEST: <br />Ci y Clerk <br />
