RESOLUTION NO. 20 <br />SERIES 2015 <br />A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT <br />BETWEEN BOULDER COUNTY AND THE CITY OF LOUISVILLE CONCERNING <br />BOULDER COUNTY'S ENVIRONMENTAL SUSTAINABILITY MATCHING GRANT <br />PROGRAM, FOR AWARD OF A COMMUNITY GARDEN GRANT <br />WHEREAS, the Colorado Constitution Article XIV, Section 18(2)(a) and C.R.S. §29 -1- <br />201 et seq. provide that political subdivisions of the State may contract with one another to <br />provide any function, service, or facility lawfully authorized to each of the cooperating units; and <br />WHEREAS, In 2013, Boulder County created and implemented the Sustainability <br />Matching Grant Program (the "Program "), which provides an opportunity for governmental <br />organizations within Boulder County to undertake environmental sustainability priorities within <br />their communities and helped the county collectively set goals for collaborative efforts, <br />leveraging resources for a more regional approach to environmental sustainability; and <br />WHEREAS, In March 2015, Boulder County proposed recipients of the sustainability <br />grants awarded under the Program, and the City of Louisville was awarded a grant for <br />establishment of a new community garden at the intersection of Garfield and Lincoln streets (the <br />"Project "); and <br />WHEREAS, there has been proposed an Intergovernmental Agreement ( "IGA ") between <br />Boulder County and the City of Louisville for administration of the grant; and <br />WHEREAS, the parties are authorized to enter into the IGA pursuant to state law, including <br />but not limited to C.R.S. § 29 -1 -201 et seg., and the City Council by this Resolution desires to <br />approve said IGA and authorize its execution; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1. The Proposed Intergovernmental Agreement between the City of Louisville and the <br />Boulder County Concerning Boulder County's Environmental Sustainability Matching Grant <br />Program, for award of a community garden grant (the "IGA "), is hereby approved in essentially the <br />same form as the copy of such IGA accompanying this Resolution. <br />2. The Mayor is authorized to execute the IGA on behalf of the City, except that the <br />Mayor is hereby further granted authority to negotiate and approve such revisions to said IGA as the <br />Mayor determines are necessary or desirable for the protection of the City, so long as the essential <br />terms and conditions of the IGA are not altered. <br />Resolution No. 20, Series 2015 <br />Page 1 of 2 <br />
