Shipman stated that, if Council added the total tree quantity with the 14 trees that are on their <br />property, there is a total of 59 trees. The Guidelines state 53 perimeter trees and 10 interior trees, <br />so they are four trees short without any shrub calculations, compensating them for trees. He felt they <br />could find room for four trees. <br /> <br />Wood took exception to the number of trees, because the Planning Commission moved the entry <br />feature back into the property, because HSG had dedicated Tract A to the City of Louisville. <br />Therefore, they did not want the entry feature sitting out in Tract A. The Planning Commission gave <br />them credit for the six trees on that. They did not give them credit for the four trees along the eastern <br />right-of-way. He felt the shortage still held. <br /> <br />Davidson called for Council comments. <br /> <br />Howard asked if the applicants were willing to bring the project in compliance with the Guidelines. <br /> <br />Avery stated that they would add four trees tonight. <br /> <br />Sisk moved that Council continue Resolution No. 47, Series 1995, to September 19 to allowing Ruby <br />Tuesday to come into compliance with the Gateway Guidelines. He hoped Ruby Tuesday would have <br />a representative at that meeting. Seconded by Lathrop. All in favor except Howard and Davidson, <br />with Levihn being absent. <br /> <br />Mayer stated that when Ruby Tuesday comes back he wanted compliance with the Gateway <br />standards. He wanted the applicant to accept full responsibility for the storm sewer easement. If so, <br />he would accept landscaping in that area. He would look at the trees around the building, if they <br />hadn't already been included. Also, the area by the entry could be included. <br /> <br />Lathrop and Sisk stated that they would go to Denver to look at the Ruby Tuesday to observe the <br />project. <br /> <br />RESOLUTION NO. 48, SERIES 1995 - APPROVING AN AMENDMENT TO RESOLUTION <br />NO. 73, SERIES 1992 FOR RIDGEVIEW ESTATES <br /> <br />Paul Wood, Planning Director, stated that this is to amend a condition of approval for Ridgeview <br />Estates on Lots 67 and 68: "Walk out basements shall be prohibited on Lots 67 & 68 and the rear <br />building elevation on Lot 67 shall be restricted to a garden level." He pointed out that these lots <br />back up against dedicated open space. The applicant requested that the amendment be revised to <br />state that those lots shall be limited to one-story, ranch construction homes only, walkout basements <br />are allowed, maximum overall building height from finish grade to peak of roof shall not exceed 31' <br />from the rear building elevation. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />9 <br /> <br /> <br />
