ORDINANCE No. 1685, SERIES 2015, AN ORDINANCE GRANTING A NON- <br />EXCLUSIVE FRANCHISE BY THE CITY OF LOUISVILLE TO COMCAST OF <br />COLORADO I, LLC AND ITS LAWFUL SUCCESSORS, TRANSFEREES AND <br />ASSIGNS, FOR THE RIGHT TO MAKE REASONABLE AND LAWFUL USE OF <br />RIGHTS -OF -WAY WITHIN THE CITY TO CONSTRUCT, OPERATE, <br />MAINTAIN, RECONSTRUCT, REPAIR AND UPGRADE A CABLE SYSTEM <br />FOR THE PURPOSE OF PROVIDING CABLE SERVICES WITHIN THE CITY — <br />2 "d Reading — Public Hearing <br />2. LETTER OF AGREEMENT BETWEEN THE CITY OF LOUISVILLE AND <br />COMCAST <br />Mayor Muckle requested a City Attorney introduction. <br />City Attorney Light introduced Ordinance Nos. 1685 and 1686, Series 2015 and the <br />Letter of Agreement between the City of Louisville and Comcast. <br />Mayor Muckle opened the public hearing and requested a staff presentation. <br />Public Relations Manager Muth explained before the Council is the ordinance granting a <br />Comcast Cable Franchise, the ordinance reestablishing the City of Louisville Cable <br />Television Standards, and a letter of agreement. Comcast Cable is currently the only <br />source of cable television services in Louisville, and serves approximately 4,500 <br />subscribers. They are currently working under a month -to -month agreement based on <br />the 2006 franchise. It is a non - exclusive franchise and the City is open to other <br />providers. The Franchise does not cover rates, cable packages or broadband. The <br />Franchise does cover use of the right -of -way; Access Channels (Public, Educational <br />and Government) and Franchise and PEG Fees. The proposed agreement is unlikely <br />to resolve most of the issues residents have with Comcast. The negotiating team tried <br />to address what they could under current law while balancing cost and impacts.
