All in favor except Lathrop and Levihn. <br /> <br />LEWISVIEW CORPORATION <br /> <br />DISCUSSION/MOTION - ANNEXATION AGREEMENT AND ADDENDUM <br /> <br />Paul Wood, Planning Director, stated that the addendum provides three requests that are integral to <br />their desire to move forward with the annexation. <br /> <br />1.) <br /> <br />3.) <br /> <br />As a condition of annexation, zoning would be granted as SF-R and AO-T; <br />The City will allow the property owner to disconnect if the City does not act to <br />approve a preliminary PUD within 180 days of its submission, or to approve a final <br />PUD within 180 days from the date of its submission; <br />Water fights would not be dedicated at the time of annexation, but would be held in <br />escrow until approval of the final PUD, or returned to the owner if the final PUD is <br />not approved. <br /> <br />Wood had a letter indicating that as of October 12 Lewisview Corporation is in agreement with the <br />revisions that were incorporated into this addendum after review by staff and the City Attorney. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />John Durham, Land Planner with the Norris Dullea Company, was there to answer any questions. <br /> <br />Don Ostrander, legal counsel for Lewisview Corporation, suggested that a sentence be added to <br />paragraph No. 6 that the escrow will remain until such time as the rights granted under the PUD vest. <br /> <br />Davidson called for Council questions. <br /> <br />Mayer was concerned that the City had committed City Attorney and staff time to a project which <br />had never received any Council direction. <br /> <br />Lathrop asked if the concept plan being presented met the SF-R zoning. <br /> <br />Wood stated that it does not. It would need the corresponding PUD process in order to be approved <br />under the requested zone districts. <br /> <br />Davidson did not want to move forward with this annexation until this had gone through the formal <br />public hearing process. He asked the City Administrator, as head of City staff, if he recommended <br />that all annexations come forward on a non-standard basis or that a significant number of them do. <br /> <br /> <br />
