RESOLUTION NO. 78 <br />SERIES 2015 <br />A RESOLUTION APPROVING THE DELO FLATS PRELIMINARY SUBDIVISION <br />PLAT, SPECIAL REVIEW USE (SRU) AND A PRELIMINARY PLANNED UNIT <br />DEVELOPMENT (PUD) TO DEVELOP MIXED -USE COMMERCIAL, 13 LIVE/VVORK <br />UNITS AND 33 APARTMENT UNITS <br />WHEREAS, there has been submitted to the Louisville City Council an <br />application for approval of a preliminary Subdivision Plat, special review use (SRU) and <br />a preliminary Planned Unit Development (PUD) to develop Mixed -Use Commercial, 13 <br />live /work units and 33 apartment units; and <br />WHEREAS, the subject property is in the Highway 42 Revitalization Area; and <br />WHEREAS, Section 17.14.020 of the LMC requires any property in the Highway <br />42 Revitalization Area be rezoned in conformance with the Land Use Plan incorporated <br />as Exhibit A in LMC Chapter 17.14 before being developed or redeveloped; and <br />WHEREAS, the Land Use Plan (Exhibit A) requires the existing Industrial (I) <br />zoning to be rezoned to Mixed -Use Residential (MU -R) and Commercial Community <br />(CC); and <br />WHEREAS, the ground floor residential along Cannon Street requires a special <br />review use permit and staff has found the request with conditions meets the five criteria <br />established in Section 17.40.100 in the LMC; and <br />WHEREAS, the City Staff has reviewed the information submitted and found it to <br />comply with the LMC Sec. 16.12.030, Sec. 17.14.090, Sec. 17.28.170; and Sec. <br />17.40.100. <br />WHEREAS, after a duly noticed public hearing on October 16, 2015 where <br />evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission Staff Report dated September 10, 2015, the Planning <br />Commission Recommended the DELO Flats SRU, Rezoning, Preliminary Subdivision <br />Plat, and Preliminary PUD Plan, be approved with the following conditions: <br />1. Defer the sidewalk width waiver request until final submittal. <br />2. Remove any reference to a street tree allotment of 1 street tree per 50 feet of <br />street frontage. <br />3. Easement concerns, with the Louisville Trade Center Plat, will be resolved prior <br />to final approval. <br />4. The applicant shall demonstrate the following architectural details for the <br />residential buildings along Cannon Street at Final PUD: <br />Horizontal Variation <br />i.
