Lathrop asked the Mayor to recall that the motion that was before Council at the last meeting was to amend the Ethics Ordinance for a paid sports team coach or a volunteer sports team coach. He stated that Mr. Carnival had been deemed as an employee of the City and would therefore be in violation of the ordinance, whether he is paid or unpaid. Davidson stated that a volunteer is not a City employee. The Ethics Ordinance does not cover volunteers. He restated that if Lathrop would like to discuss Council's recommendation in asking Mr. Carnival to continue on as a volunteer head coach, it could be added to the meeting. But, if Lathrop just wanted to rehash the issue of the Ethics Ordinance, it couldn't be added. Lathrop: I would like Mr. Carnival to be an employee of the City, so that he is covered under the insurance program, which I believe is necessary, for him to be a sports team coach, especially in swimming. If he is in jeopardy under a liability position, because he is not an employee of the City, then that is not fair to Mr. Carnival. Annette Brand, City Administrator, stated that the City's insurance policy covers volunteers, so if Mr. Carnival were volunteering and someone else were paying him, he would be covered. Davidson: So, since there is not a liability issue, we can request that we discuss it as a volunteer. Lathrop: I would request that we consider him as a volunteer, so long as Mr. Carnival does not assume any personal liability as a volunteer coach for the swim team for the City of Louisville. Sisk seconded. Davidson asked if Council would object to that being added right now. No objection. Davidson stated that it would be added as Item Al, Volunteer.
