not new. The City of Boulder's Council is clear that they're going <br />to impose an impact fee. They have already rendered that opinion, <br />although they haven't done it yet. He felt that those places not <br />imposing the impact fee are the ones that are in the minority. He <br />was in favor of the impact fee and felt it should be on the ballot. <br />He stated that since the final conditions of the ordinance could <br />not be specified at this time, because they would be subject to <br />further negotiations with the School Board, he felt Council should <br />add, after "g,'. item "h," which would say that these would be <br />subject to further negotiations with the School Board. <br /> <br />Mayer stated that he would be willing to suggest that Louisville <br />consider a use tax upon building materials in lieu of a direct <br />impact fee. <br /> <br />Sisk moved that Council pass Ordinance No. 1118, Series 1993, on <br />2nd and final reading with the additional provision set forth by <br />Mayor Davidson. Seconded by Hornbostel. Roll call was taken. <br />Motion passed by a 6 - 1 vote with Lathrop voting against. <br /> <br />ORDINANCE NO. 1119, SERIES 1993, - IMPOSING A TEMPORARY SALES AND <br />USE TAX INCREASE FOR THE ACQUISITION OF LAND FOR OPEN SPACE BUFFER <br />ZONES, TRAILS, WILDLIFE HABITATS, WETLANDS PRESERVATION ANDFUTURE <br />PARKS - 2ND READING - PUBLIC HEARING (PUBL. LSVL. TIMES 8/4/93) <br /> <br />Griffiths read by title only Ordinance No. 1119, Series 1993, "An <br />ordinance imposing a temporary sales and use tax increase for the <br />acquisition of land for open space buffer zones, trails, wildlife <br />habitats, wetlands preservation and future parks." <br /> <br />Griffiths stated that the City Clerk had found that there are <br />sufficient valid signatures on the petition initiating an open <br />space tax to place the matter on the ballot. Under State law once <br />enough signatures have been certified by the City Clerk, the <br />Council is required to either adopt the initiated ordinance without <br />alteration or refer the initiated ordinance to the registered <br />electors of the City. She explained that because the initiated <br />ordinance is a tax increase, under Amendment 1 (Tabor Amendment) <br />approved last November there must be voter approval of the <br />increase, even if the Council adopts the initiated ordinance <br />without alteration. She stated that at Council's last meeting they <br />adopted on 1st reading Ordinance No. 1119, which would have adopted <br />the initiated open space tax. There were some minor amendments <br />included in that to take out some wording that would have been <br />unnecessary, if the Council adopted it directly. On reflection, <br />she encouraged Council that those words be revised and they go back <br />to the exact wording of the open space measure. In Council's <br />packet was the revised Ordinance No. 1119 with some very minor <br />variations from the one passed on 1st reading without alteration <br />adopts the ordinance that was contained within the initiative <br />petition. She told Council that which ever direction they chose to <br />go, the ballot question would remain the same. <br /> <br /> <br />
