Howard moved that Council move the 1st reading and consideration of <br />Ordinance No. 1125, Series 1993, the Harper Street right-of-way <br />vacation, and the execution of the Land Exchange Agreement to the <br />meeting on October 19, 1993. Seconded by Hornbostel. All in <br />favor. <br /> <br />ANNEXATION PETITION FILED BY ZUKAITIS <br /> <br />RESOLUTION NO. 35, SERIES 1993 - FINDING SUBSTANTIAL <br />COMPLIANCE OF AN ANNEXATION PETITION FILED BY ZUKAITIS <br />INITIATING ANNEXATION PROCEEDINGS FOR CERTAIN PROPERTY AND <br />ESTABLISHING A TIME FOR A PUBLIC HEARING TO DETERMINE IF THE <br />PROPOSED ANNEXATION COMPLIES WITH STATUTORY REQUIREMENTS <br /> <br />Davidson asked Paul Wood to cover Resolution No. 35, Series 1993, <br />Ordinance No. 1126, Series 1993, and Ordinance No. 1127, Series <br />1993 in his presentation. <br /> <br />Paul Wood, Planning Director, stated that this annexation is a <br />27,590 s.f. parcel, the westerly most enclave on Johnson Street. <br />The address is 601 Johnson Street. The initial letter of interest <br />was sent to City Council on August 17, 1993, and was referred to <br />the Planning Commission. The adjoining parcel to the east is an <br />incorporated parcel and is zoned R-L. There is property to the <br />north that is zoned R-L. The property to the east, Centennial <br />Valley Subdivision Filing No. 3, is zoned R-E. To the south is an <br />undeveloped, incorporated parcel, which is 1.5 acres in area and <br />zoned R-L. He commented that the buildable area of this parcel is <br />approximately 750' of Roosevelt Avenue. Four other developed <br />properties front the private drive and are dependant on the drive <br />for access. He stated that the applicant requested the property to <br />be zoned R-L in conjunction with the annexation. The minimum lot <br />size is for R-L is 7,000 s.f. The Planning Commission held a <br />public hearing on September 14, 1993, and with a vote of 6 - 0, <br />passed Resolution No. 19, which forwards a recommendation of <br />approval for annexation and a zone designation of RE , Residential <br />Estate. The Commission discussed in length RE vs. RR and approved <br />the RE with one condition: "The applicant be successful in <br />receiving a variance to the street design standards, as prescribed <br />by City Code, in order to develop more than one dwelling unit on <br />the subject parcel." The Commission felt that the RE would give <br />the applicant a little more flexibility. He explained that the <br />understanding was that the density is dependant upon a policy <br />issue, which will be the decision of City Council, as to whether or <br />not a public street can be extended past the city's 600' limit. In <br />order to get a public improvement that far, the city would be going <br />an additional 250' to the parcel, which is a policy issue and a <br />variance to the currently adopted City Code of not allowing any <br />more than 600' and not encouraging dead-end streets that do not <br />have the capability of being integrated into a future roadway <br />system.
