9. Maintenance of traffic signals, traffic control devices, and pavement markings <br />unless contracted with the Local Agency under separate agreement <br />Section 3. Local Agency Commitments <br />1. The Local Agency will: <br />a. Be responsible for cost of any routine or capital maintenance costs <br />associated with the aesthetic treatment upgrades included as a part of <br />the Project. This includes the basket handle arch structure. <br />2. The Local Agency shall perform at its own expense, all routine maintenance <br />activities associated with aesthetic, lighting, and pedestrian upgrades of the <br />interchange within its jurisdiction. Routine maintenance activities to be <br />performed by the Local Agency under this contract shall include, but not be <br />limited to, the following: <br />a. Maintenance of landscaping from the centerline of US 36 to the north <br />including the cost of irrigation but not including landscaping identified <br />as being the responsibility of RTD <br />b. 14' x 14' westbound off -ramp pedestrian underpass <br />a. Routine maintenance of box culvert <br />c. Maintenance of decorative fencing within the Local Agency's <br />jurisdiction (limits yet to be defined) <br />d. Maintenance of lighting from the centerline of US 36 to the north <br />including costs of power <br />e. Maintenance of all sidewalks (including snow and ice removal) from <br />the centerline of US 36 to the north. The sidewalk over US 36 is located <br />down the middle of the McCaslin Blvd over US 36 structure. The Local <br />Agency is also responsible for maintenance of this sidewalk from the <br />centerline of US 36 to the north <br />f. Keeping the roadway free from obstructions and impediments that may <br />interfere with bicycle, pedestrian, and automotive traffic, including sand <br />and debris; signing, striping and electrical lighting fixtures installed <br />along the structure and roadway for that portion within the Local <br />Agency's jurisdiction <br />Mowing, tree and shrub upkeep; removal of graffiti shall be performed <br />in accordance with the Local Agencies policies and procedures. <br />g. <br />Section 4. Term and Termination Provisions <br />1. This Agreement shall be in effect only after it is executed by both parties. The <br />Maintenance obligations of the Local Agency under this Agreement shall commence on the <br />date of the final written acceptance of the McCaslin Blvd. interchange by CDOT, after <br />completion of the CDOT -Local Agency final walk through and Concessionaire's addressing <br />Page 3 of 9 <br />
