Publication and <br />proper notice of public hearing were established. <br />Mayor Fauson opened the public hearing. <br />Wanush explained that Derek and Cara Anderson are <br />requesting the annexation of their property at 375 <br />South 80th which is located west of McCaslin across <br />from Harper Lake. 'This is the first of two <br />annexation ordinances prepared for the property; two <br />are needed in order to comply with the statutory <br />requirement for 1/6 contiguity to the existing City <br />limits. Planning Commission reviewed the two <br />annexation requests and determined that both meet all <br />municipal and state criteria regarding annexation. <br />They recommended approval without conditions. The <br />Public Works Department will have a 30 ft. easement <br />for a frontage drive along the west side of McCaslin <br />and this will be shown on the plat. To avoid an <br />open cut on McCaslin, the water connection is to be <br />bored under the roadway adequate to serve potential <br />users, estimated to be no less than 6 inches. <br />Mayor Fauson asked :Eor public comments either in <br />favor of or in opposition to this Ordinance. None. <br />Szymanski asked if 1Kr. Anderson would be entitled to <br />recovery fees for the installation of the 6 inch <br />water connection. Wanush stated that he would be. <br />Mayor Fauson closed the public hearing and called <br />for a motion. Mohr moved that Ordinance #940 be <br />adopted. Anderson :seconded. By Roll Call Vote, <br />Ordinance #940 was adopted unanimously. <br />ORDINANCE #941 - ANDERSON ANNEXATION #2 - <br />PUBLIC HEARING Rautenstraus read b~~ title only Ordinance #941, "An <br />Ordinance annexing t:o the City of Louisville, <br />Colorado, a parcel of property of approximately 4.139 <br />acres located west of McCaslin Boulevard which is <br />owned by Derek and Cara Anderson.." Publication and <br />proper notice of public hearing were established. <br />Mayor Fauson opened the public hearing. <br />Wanush asked that hi.s presentation and remarks during <br />the previous Agenda Item relating to Ordinance #940 <br />be accepted as part of the record for Ordinance #941. <br />Mayor Fauson asked for any public comments either in <br />favor of or in oppo:cition to Ordinance #941. None. <br />Mayor Fauson closed the public hearing and called <br />for a motion. <br />3 <br />
