Later they <br />can finish their basements and this portion is not <br />assessed the $2.25. The homes in question in this <br />annexation fall well beneath the $5,000 cap. <br />Hundley also feels that not having a cap could <br />create a disincentive where there are homes <br />outside the City using City services who are <br />unwilling to pay such high fees in order to annex. <br />Szymanski feels that it penalizes the average <br />person and would rather see an across the board <br />percentage for everyone. <br />Sackett suggested that this issue be resolved in <br />a Work Session but feels that it isn't a concern <br />in this particular annexation request as the homes <br />in question are 1500 s.f. or less. <br />Mayor Fauson closed the public hearing and asked <br />for a motion. <br />Mohr moved that Ordinance #896 be approved with <br />the conditions recommended by the Planning <br />Commission. Fauson seconded. <br />Szymanski moved to amend the motion by removing <br />the $5,000 cap under condition #4. There was not <br />a second to the motion and thereby was defeated. <br />By Roll Call Vote, Ordinance #896 was adopted 6-1 <br />with Szymanski voting no. <br />ORDINANCE #897 - ZONING REQUEST - FIECHTLE, JOSEPH AND PROUTY - <br />PUBLIC HEARING Rautenstraus read by title only Ordinance #897, <br />"An Ordinance amending Title 17 of the Louisville <br />Municipal Code of the City of Louisville entitled <br />"Zoning" by zoning property of approximately 22.27 <br />acres owned by Spruce Street Fiechtl, Limited, <br />Spruce Street Joseph, Limited and Jonathan Prouty <br />annexed to the City by Ordinance No. 896." Proper <br />publication and notice of public hearing were <br />established. <br />Mayor Fauson opened the public hearing. <br />Wanush explained that the zoning request follows <br />the annexation request of the prior agenda item. <br />The request is for Rural Residential zoning which <br />has a minimum lot area of 20,000 s.f.
