Unanimous. <br />ORDINANCE #918 - HEALTH PARK ANNEXATION #1 - <br />PUBLIC HEARING (Sackett and Anderson asked to be excused from the <br />proceedings on Ordinance #918 and Ordinance #919 <br />due to possible conflict of interest.) <br />Rautenstraus read by title only Ordinance #918, <br />"An Ordinance annexing to the City of Louisville, <br />Colorado, a parcel of approximately 7.213 acres <br />located north of U. S. Highway 36 and west of 88th <br />Street which is owned by Harold W. Spicer." <br />Proper publication and notice of publication were <br />established. <br />Mayor Fauson opened the public hearing. <br />Wanush explained that this is the first of two <br />annexation ordinances annexing the Spicer property <br />by the Adventist Health System for the purposes of <br />constructing a full service hospital and health <br />complex. Two ordinances are needed to comply with <br />the statutory requirement for 1/6 contiguity to <br />the existing City limits. Planning Commission <br />reviewed this annexation and found that it <br />complied with all state statutes and City <br />ordinances. They recommend that the City Council <br />approve the annexation with the following condi- <br />tions: 1) the future development of this entire <br />parcel should be subject to a single PUD; 2) all <br />water rights should be dedicated to the City (1 <br />share of South Boulder and Coal Creek and 1 share <br />of Marshall Lake). In addition, if during the PUD <br />process it is concluded that total water use of <br />the fully developed health park is greater than <br />the water rights dedicated plus the amount of <br />water able to be purchased with 57$ of the tap <br />fees, the developer shall pay the City the <br />difference. Fees toward the purchase of needed <br />raw water should be prepaid on a schedule to be <br />determined at the time of PUD; 3 ) at the time of <br />subdivision and PUD, a 12$ land dedication, or <br />cash in lieu, should be made, 4) all costs of <br />extending service to the property shall be born.- <br />by the developer; and 5) at the time of PUD, a <br />traffic study should be completed by the applicant <br />to determine the traffic impacts of the completed <br />facility on Dillon Road, South 88th St. and other <br />roads and facilities in the area. <br />Wanush outlined the criteria established by both <br />State Statutes and by City Ordinance when <br />considering annexation.
