Lipton moved to <br />approve the Consent Agenda. Machado seconded. All in favor. Carlson absent. <br />Authority Business <br />A. Petition to Pay Fine in Lieu — Waterloo Icehouse, Inc. d /b /a Waterloo <br />Icehouse — Tavern Liquor License — 809 Main Street <br />Chairperson Tennessen noted there was a Petition to Pay a fine in lieu of <br />suspension in the packet. This follows the Stipulation and Order accepted by the <br />Authority at the last meeting imposing a 14 day suspension with 7 days held in <br />abeyance. <br />Authority Attorney Gulley noted the licensee, owner Josh Karp and his attorney, <br />Todd Stoneman, were in the audience if they wished to speak on the petition. <br />She reminded the Authority the Louisville Municipal Code calls for the Authority <br />to make three findings before accepting the petition to pay the fine in lieu. Those <br />findings are: <br />1. The public welfare and morals would not be impaired by permitting the <br />licensee to operate during all or a portion of the period set for suspension, and <br />that payment of the fine will achieve the desired disciplinary purposes; and <br />2. The books and records of the licensee are kept in such a manner that the <br />loss of sales of alcohol beverages which the licensee would have suffered had <br />the suspension gone into effect can be determined with reasonable accuracy <br />therefrom; and <br />3. The licensee has not had its license suspended or revoked, nor had any <br />suspension stayed by payment of a fine, during the two years immediately <br />
