Hundley stated that staff will certainly take a <br />look at the Mayor's request, but has concern as to <br />whether, from a legal standpoint, that can serve as <br />a basis for denial of a liquor license. If it can <br />not, Hundley questions whether it would be worth <br />the time and effort to evaluate the economic <br />factors. <br />Rautenstraus concurred and suggested that staff <br />prepare a memo on criteria appropriate to review <br />and have it available before the next meeting. <br />Then if there were additional information that <br />Council would want: to request of the applicant, or <br />from staff, there would be ample time to achieve <br />this. <br />Mayor Meier asked that the memo be prepared as <br />Rautenstraus suggested. <br />Luce commented that he is not sure that it is <br />appropriate for local government to try to dictate <br />something that should be decided in the <br />marketplace - that. is whether or not it is <br />feasible for a business to come into a community <br />and compete with other business. "In terms of <br />looking at the questions of competition, whether <br />or not that is legal, I just want to be up front <br />right now and say I don't think that that is an <br />appropriate criteria for Council to be involved in <br />examining," Luce stated. <br />Hundley stated that the needs and desires of the <br />neighborhood must be established by an applicant <br />for a liquor license. Currently the City <br />describes the neighborhood as the entire City and <br />is appropriate in most circumstances. <br />Mayor Meier moved that a Public Hearing be set for <br />November 7, 1985, for the UnionJack Liquors retail <br />liquor license application. Luce seconded. <br />Unanimous. <br />COUNCIL COMMENTS Fauson asked that ordinances from other cities <br />dealing with the keeping of a vicious dogs be <br />looked at very carefully as mail carriers have <br />been attacked. <br />Luce referred to letters from the Wildflower <br />Subdivision residents (McStain) relative to <br />suggested PUD guidelines that McStain might want <br />to look at for some of their new developments. <br />Luce asked if Wanush had time to look into these <br />suggestions and asked how that fits into what the <br />staff is doing relative to comprehensive PUD <br />guidelines.
