Louisville City Council Meeting <br />May 20, 2003 <br />Page 8 of 11 <br /> <br />Sisk stressed it is important that these units remain senior independent living units, and <br />any conversion would require raising rates to the then existing water tap fee. He asked if <br />other senior facilities would be affected by this ordinance, such as Lydia Morgan and <br />would they be refunded their development fees. <br /> <br />Keany noted the Lydia Morgan development was a Louisville Housing Authority project <br />and assessed the full price for water taps, however other development fees were waived. <br /> <br />Marsella noted that Lydia Morgan does not fall into the same category because of the <br />level of congregate care. <br /> <br />Brown stated the ordinance defines a deed restriction to senior independent living units. <br /> <br />MOTION: Sisk moved that Council send out Ordinance No. 1421, Series 2003 for <br />publication and set a public hearing for June 3, 2003, seconded by Keany. All in favor. <br /> <br />AUTHORIZE EXECUTION OF REVISED PUBLIC UTILITIES COMMISSION <br />APPLICATION FOR BNSF FUNDING OF RAILROAD BRIDGE STRUCTURE <br />FOR THE HIGHWAY 42/96TM STREET CONNECTION PROJECT <br /> <br />Davidson called for Staff presentation. <br /> <br />Public Works Director Tom Phare explained the revised Public Utilities Commission <br />application is the result of the BNSF decision not to support the railroad-lowering project. <br />Their decision was based on the City pursuing PUC funding for grade-separating <br />crossing. He stated the Public Works Department recommends the rail-lowering <br />component of the project be maintained as a high priority and the PUC application be <br />revised to eliminate reference to grade separating crossing, unless a maintenance <br />agreement for lowering cannot be negotiated. In that case the City could proceed with <br />PUC application for funding. <br /> <br />MOTION: Keany moved that Council authorize the Mayor and City Clerk to execute <br />the revised Public Utilities Commission application for crossing with the BNSF railroad <br />on the Highway 42/96th Street project, seconded by Brown. All in favor. <br /> <br />DISCUSSION/DIRECTION - RESULTS OF LIBRARY POLL <br /> <br />Davidson called for Staff presentation. <br /> <br />Heather Balser reported results of the library poll have been distributed to the Council <br />and are available at the library for public review. <br /> <br />COUNCIL COMMENTS <br /> <br /> <br />
