INTERGOVERNMENTAL AGREEMENT <br />This INTERGOVERNMENTAL AGREEMENT (the "IGA") is made and entered into as <br />of the 714day of f'E,t*€' J$C>t , 2017 (the "Effective Date"), by and between the TOWN <br />OF SUPERIOR, a Colorado municipality with an address of 124 East Coal Creek Drive, <br />Superior, Colorado 80027 (the "Town"), and the CITY OF LOUISVILLE a Colorado home rule <br />municipality with an address of 749 Main Street, Louisville, CO 80027 (the "City") (each a <br />"Party" and together, the "Parties"). <br />WHEREAS, McCaslin Boulevard runs through both the Town and the City and is a <br />significant arterial road for both municipalities; <br />WHEREAS, especially between Dillon Road and Coal Creek Drive, McCaslin Boulevard <br />carries significant traffic and provides access to U.S. Highway 36 and multiple commercial <br />areas; <br />WHEREAS, disruption of traffic on McCaslin Boulevard by construction activities <br />negatively impacts both the Town and the City; <br />WHEREAS, Part 2 of Article 1 of Title 29, C.R.S. permits and encourages governments <br />to make the most efficient and effective use of their powers and responsibilities by cooperating <br />and contracting with other governments; and <br />WHEREAS, in this spirit of cooperation and to minimize negative traffic impacts, the <br />City and Town would like to agree as set forth below to limit the hours of road construction work <br />on McCaslin Boulevard. <br />NOW THEREFORE, in consideration of the terms and conditions of this IGA, and other <br />good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, <br />the Parties agree as follows: <br />1. Term and Termination. This IGA shall commence upon the Effective Date and shall <br />terminate on December 31, 2017, provided that this IGA shall automatically renew for <br />successive one-year terms unless written notice of nonrenewal is provided on or before <br />December 1 of any given year. Either Party may terminate this IGA upon 90 days' prior written <br />notice to the other Party. <br />2. Scope. The Town and the City hereby agree to limit the hours of road construction work <br />on McCaslin Boulevard in the area between Dillon Road and Coal Creek Drive, as more <br />specifically shown on Exhibit A attached hereto and incorporated herein (the "Restricted Area"), <br />as provided in this IGA. This IGA shall apply to any work in or near the Restricted Area <br />requiring or including the closure of one or more lanes of traffic.
