City Council <br />Meeting Minutes <br />June 13, 2017 <br />Page 6 of 11 <br />Tax Manager Penney Bolte stated the Finance Committee has reviewed and <br />recommends this ordinance. This update is key to the business community as it gives <br />them continuity between Colorado jurisdictions when determining if an item is taxable <br />This ordinance proposes 72 of the standard definitions be amended. <br />The ordinance also amends some other sections of this Chapter it clarifies that the <br />statute of limitations is tolled based on engagement for audit and sets new guidelines <br />and policies affecting administrative hearings, it amends the Lodging Tax process <br />requiring a separate statement of taxes owed on invoices or billing statements; and it <br />requires payment of any excess tax collected by a taxpayer. <br />Attorney Light stated the changes are drafted to remain revenue neutral to the City's tax <br />base but does delete pay television as a taxable item These provisions are being <br />deleted in connection with the resolution of the pending litigation with Comcast which is <br />a matter of public record. <br />Mayor Muckle asked for public comment; none. <br />Councilmember Stolzmann stated she could only comment on the portions of the <br />ordinance that pertain to the sales and use tax definitions project. The Finance <br />Committee has reviewed those proposed changes. She noted it reduces the <br />complication for businesses when they determine what they might owe. She noted the <br />changes to the administrative review make it much easier for people to handle simple <br />issues related to their tax payments <br />Councilmember Keany asked if shipping charges are taxable Manager Bolte stated the <br />definitions have been incorporated The City does not charge tax on shipping, but the <br />State of Colorado does. <br />Mayor Muckle asked for public comments; none Mayor Muckle closed the public <br />hearing. <br />Councilmember Maloney moved to approve the ordinance; Mayor Muckle seconded <br />Vote: Motion carned by unanimous roll call vote. <br />DISCUSSION/DIRECTION/ACTION — OPTIONS TO REFER TO THE VOTERS A <br />CONTINUATION OF THE HISTORIC PRESERVATION SALES TAX <br />Deputy City Manager Balser stated that at a study session in April the City Council <br />requested staff come back with options to continue the City's temporary sales and use <br />tax for histonc preservation purposes for an additional ten years commencing January <br />1, 2019.
