Update - V1later Resources <br />a. 2008-2009 Water Supply and Demand Analysis -the usual table and <br />chart was handed out showing the projected demand, storage and <br />diversions through the end of 2009. Staff explained the assumptions <br />used in the analysis, how the numbers could vary dependent on; <br />runoff, weather, demand, etc. The City's water situation is looking <br />good based on current conditions. <br />b. Lease Opportunities -summarized past, .current and potential leases <br />for 2008. Staff wilt continue to lease out surplus water when the <br />opportunity arises. <br />~BIII. Lega( Report -City Staff summarized the status of the following items: <br />a. Counsel provided a quick summation of non-tributary and not-non- <br />tributary ground water since, it has been in the press lately. This <br />applies more to entities like Douglas County. The City of Louisville's <br />system uses renewable surface water supplies. <br />b. Junior well rights on the South Platte are being addressed adequately <br />by other parties thus, the City is not a party in any of those cases. <br />c. The Court has ruled in the FRICO/City of Boulder lawsuit. Under the <br />ruling the City of Boulder may alter the irrigation box under Hwy 93 for <br />the purposes of a trail. Numerous terms and conditions were placed <br />on Boulder for such use. FRICO is appealing the decision and the City <br />may make an appearance in the appeal to keep informed on the <br />proceedings. <br />d. Counsel provided an update on resolved and pending Water Court <br />Cases that the City is involved in (Eldora, Stern's Lake, Broomfield, <br />etc.). <br />e. Marshall Lake/South Boulder and Coal Creek Ditch Transfer -The <br />Water Court Application was filed in December and individuals and <br />entities had until March 1 to file Statements of Opposition. The <br />Statements of Oppositions filed were routine and from expected <br />parties. Staff will be sending out the Engineering Report for the <br />transfer in the next few weeks. if the concerns of the opposers cannot <br />be addressed this case would go fo Water Court sometime in 2010. <br />f. Members asked if Eldorado Springs was planning to lease water at <br />Eldorado Springs this year. The City has not been asked far a lease <br />and Eldorado Springs is pursuing augmentation water from a variety of <br />other sources in their Substitute Water Supply Plan and Court Case. <br />g. Committee Members .expressed their appreciation for working with <br />others to get through impasses instead of litigating everything. <br />
