City Council <br />Meeting Minutes <br />September 2, 2008 <br />Page 7 of 13 <br />MOTION: Councilor Sackett moved to approve Resolution No. 40, Series 2008, <br />seconded by Mayor Pro Tem Marsella. Roll call vote was taken. The motion <br />carried by a vote of 7-0. <br />RESOLUTION No. 41, SERIES 2008 - A RESOLUTION AMENDING THE 2008 <br />BUDGET BY INCREASING APPROPRIATIONS IN THE GENERAL FUND AND <br />THE CAPITAL PROJECTS FUND -PUBLIC HEARING <br />Mayor Sisk opened the public hearing and requested a Staff presentation. <br />City Manager Fleming explained the resolution proposes a supplemental <br />appropriation to the City of Louisville's 2008 operating and capital budget. The <br />purpose of this proposed budget amendment is to provide funding for the <br />acquisition of the Downtown Post Office site, including the cost for an appraisal, <br />survey, environmental assessment, asbestos survey and closing costs. The <br />acquisition of the site will be made from the City's Capital Projects Fund. <br />Mayor Sisk requested public comment. There were no comments <br />COUNCIL COMMENT <br />Councilor Dave Clabots asked if the additional $300,000 would also be <br />appropriated. Mayor Sisk explained that the City would still pay only $1.5 million <br />and the sellers would receive a tax credit of $300,000. <br />Mayor Sisk closed the public hearincl. <br />MOTION: Mayor Pro Tem Marsella moved to approve Resolution No. 41, Series <br />2008, seconded by Councilor Sackett. Roll call vote was taken. The motion <br />carried by a vote of 7-0. <br />RESOLUTION No. 42, SERIES 2008 - A RESOLUTION APPROVING A <br />SPECIAL REVIEW USE (SRU) TO INCREASE THE DINING HOURS OF THE <br />OUTSIDE PATIO OF 809 MAIN STREET (WATERLOO ICEHOUSE) <br />Mayor Sisk requested a Staff presentation. <br />Planning Director Wood explained the owner, Joshua Karp, of Waterloo Icehouse <br />Inc., has applied for an amendment 1:o an existing Special Review Use (SRU) to <br />increase the hours of operation on the existing patio from 10 p.m. to 2 a.m. The <br />applicant believes the extended hours will be beneficial for the dinner time <br />customers. The current hours of operation for the outside patio were established <br />on the original SRU, approved on August 7, 2007. During the Planning <br />Commission public hearing process, the residential neighbors located west of the <br />Waterloo Icehouse were concerned about the potential conflict with noise levels <br />
