Columbia Savings' <br />position was that they would make the funds <br />available immediately, if Columbine Homes <br />can secure assurances of adequate. building <br />permits as outlined in the subdivision agree- <br />ment dated September 6, 1983. Also Columbia's <br />position was simple and straightforward, they <br />cannot fund a development loan if Columbine <br />cannot sell, build and close homes. For <br />the remainder of 1984 they were requesting <br />Certificates of Occupancy and taps for the <br />following:November, 1984 10 <br />December,;1984 10 <br />Certificates of Occupancy for 1985 <br />January 12 <br />February 10 <br />March 5 <br />April 12 <br />May 12 <br />June 12 <br />July 12 <br />Mr. Brishehan stated that Columbine Homes <br />would place its own moratorium on any land- <br />scaping, sodding or seeding on all the above <br />mentioned homes, until the City is satisfied <br />that the water shortage has been eliminated, <br />or October, 1985 whichever occurs sooner. <br />Mr. Brisnehan proposed the following council <br />action to resolve this situation to the <br />satisfaction of the City of Louisville, <br />Columbia Savings and Loan Association, as <br />well as Columbine Homes. <br />1. Authorize the fast tract design and con- <br />struction of the Howard Berry Water Plant <br />as proposed by Homart. <br />2. Remove the moratorium on 1984 building <br />permits, with the condition that the units <br />will not be occupied until October 1, 1984. <br />3. Allow 1985 permits to be issued next year <br />with the condition that no landscaping will <br />be permitted until the City has determined <br />that the water supply problem has been corrected, <br />or until October 1, 1985. <br />Councilman Luce Stated our primary problem is one of safety. <br />It was his opinion that if Columbine Homes <br />had a problem with their lending instituion <br />that perhaps they should obtain the services <br />of another. He felt that water was a secondary <br />issue in this matter; it was a problem of in- <br />gress and egress from the subdivision onto <br />South Boulder Road. <br />
