RESOLUTION NO. 55 <br />SERIES 2017 <br />A RESOLUTION APPROVING A CONTRACT BETWEEN THE COLORADO <br />DEPARTMENT OF TRANSPORTATION AND THE CITY OF LOUISVILLE <br />CONCERNING SIGNAL MAINTENANCE ON STATE HIGHWAY 42 <br />WHEREAS, C R S § 29-1-203 authonzes the City and Colorado Department of <br />Transportation ("CDOT") to cooperate or contract or enter mto agreements with one another to <br />provide any function or for the joint exercise of a function, service or facility, and <br />WHEREAS, C R S § 43-2-144 authonzes CDOT and local governments to contract for the <br />construction or maintenance, or both, of City streets or county or state highways within the City, <br />and <br />WHEREAS, there has been proposed a contract between CDOT and the City to <br />designate maintenance responsibilities for the traffic signals at State Highway 42 and South <br />Boulder Road and at State Highway 42 and Paschal Dnve, and <br />WHEREAS, the City Council finds that the proposed contract is m the best interests of the <br />City and its citizens, and by this resolution desires to approve the contract and authonze its <br />execution, <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1 The City Council hereby approves that certain contract between the City of <br />Louisville and the State of Colorado for the use and benefit of the Colorado Department of <br />Transportation to designate maintenance responsibilities for the traffic signals at State Highway <br />42 and South Boulder Road and at State Highway 42 and Paschal Drive (the "Contract"). A copy <br />of the Contract is attached hereto and incorporated herein by this reference <br />2 The Mayor is hereby authonzed to execute the Contract on behalf of the City <br />Council of the City of Louisville, except that the Mayor and the City Manager are hereby further <br />authorized to negotiate and approve such revisions to the Contract as the Mayor or City Manager <br />determines are necessary or desirable for the protection of the City, so long as the essential terms <br />and conditions of the Contract are not altered <br />3 The Mayor, City Manager and City staff are hereby authorized to execute all <br />documents and do all other things necessary on behalf of the City to perform the obligations of <br />the City under the Contract, mcludmg but not limited to execution of all certifications, forms, <br />memoranda of understanding, and other documents required m connection with the Contract and <br />prod ect <br />Resolution No 55, Series 2017 <br />Page 1 of 2 <br />
