Louisville City Council Meeting <br />September 7, 2004 <br />Page 5 of 12 <br /> <br />Finance Director Patty Leslie stated Resolution No. 39, Series 2004, amends the 2004 <br />budget for two items: <br /> · The 2004 Appropriations in the Capital Projects Fund to allow for the <br /> expenditures of funds reserved for Community Investment Fees refunds of <br /> $420,989. <br /> · An increase in the 2004 Appropriations in the Capital Fund for $308,149 to allow <br /> for expenditures of funds reserved for School Improvements. <br /> <br />MOTION: Council member Van Pelt moved for approval of Resolution No. 39, Series <br />2004, seconded by Council member Brown. Roll call vote was taken. The motion <br />passed by a vote of 7-0. <br /> <br />RESOLUTION NO. 40, SERIES 2004 - A RESOLUTION SETTING A BALLOT <br />TITLE FOR PROPOSED INITIATED AMENDMENTS TO THE LOUISVILLE <br />HOME RULE CHARTER AND AUTHORIZING CERTAIN OTHER ACTIONS <br />IN CONNECTION WITH A SPECIAL ELECTION ON SUCH AMENDMENTS <br />TO BE HELD ON NOVEMBER 2, 2004 <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />City Attorney Sam Light explained that on August 2, 2004, a signed initiative petition <br />was filed with the City Clerk for proposed amendments to the Home Rule Charter. The <br />City Clerk reviewed the signed petitions and on August 17 certified to City Council that <br />the petition has a sufficient number of valid signatures. <br /> <br />City Attorney Light explained that State Statutes require the City Council set a ballot title <br />for the proposed Charter Amendments. Resolution No. 40, Series 2004 sets the ballot <br />title for the proposed Charter amendments. The Charter does not contain criteria for <br />setting ballot titles for Charter amendments, but general law is that the ballot title must <br />indicate the effect of amendment if approved. The ballot title should be drafted as a <br />generally understandable "yes" or "no" question, and should not be inadequate, deceptive <br />or misleading. Resolution No. 40, Series 2004 also confirms the special election on the <br />initiated Charter amendments will be held on November 2, 2004. It also directs the City <br />Clerk to certify the ballot title to the County, as the November 2 election will be a <br />coordinated general election. The ballot title must be certified to the County by <br />September 8. <br /> <br />COUNCIL COMMENT <br /> <br />Council member Keany stated Draft Title #1 is long and difficult to read, however, Title <br />#2, does not fully explain the proposed charter amendments. Council member Van Pelt <br />concurred. Mayor Sisk preferred draft Title # 1, and requested that Staff prepare a cost <br />analysis of the implementation of the Charter Amendments. Council member Marsella <br />favored Draft #1, and stated it fully informs the electorate. <br /> <br /> <br />
