Goodman stated his belief the two-week notice is not required. <br /> <br />City Attorney Light stated the state statute requires a local ordinance. He compared the <br />proposed ordinance with the Broomfield's, and noted some communities are requiring <br />other provision such as calendared days, and individual permits. <br /> <br />Mayor Sisk suggested the two-week notification period be modified to two-days, with <br />written notification by mail or fax. <br /> <br />Council member Keany inquired as to the permit process. Deputy City Clerk Hanson <br />stated the permit would be for a calendar year. <br /> <br />Mr. Owen noted for wine tasting charity events, no notice is required. He did not oppose <br />the two-day notice provision. <br /> <br />MOTION: Council member Brown moved for Council approval of Ordinance No. 1457, <br />Series 2004, with the revision that the last sentence of limitation #13 be struck. Council <br />member Levihn seconded the motion. Roll Call vote was taken. The motion passed by a <br />vote of 7-0. All in favor. <br /> <br />ORDINANCE NO. 1453, SERIES 2004 - CONTINUED <br /> <br />Mayor Sisk asked Ms. Levy if she had consulted with her clients. Mr. Levy stated the <br />applicant would like a continuance for further discussions. Based on the outcome of those <br />discussions, the applicant may elect to withdraw their application and file a different <br />application. She requested a straw vote from Council on how they wished to proceed. <br /> <br />Council member Brown stated there is an opportunity to revisit this matter. He felt it was <br />unfair to drag this matter out any longer. <br /> <br />Council member Levihn questioned whether the Council should take a straw vote. <br /> <br />City Attorney Light suggested if Council is interested in sending this back for <br />renegotiation, Staff would have to receive Council direction. He reviewed the Councils' <br />option of: 1) voting in favor of vacation, 2) against vacation, or continuing the matter. <br /> <br />Mayor Sisk asked Council for their preference of proceeding with this matter. Council <br />members Van Pelt, Clabots, Keany, and Levihn favored continuing this matter. Council <br />member Marsella supported the options offered by Planning Director Wood. Council <br />member Brown favored expanding the options. Mayor Sisk stated his belief that Council <br />is willing to try to resolve this issue. <br /> <br />10 <br /> <br /> <br />
