described in Subsection C; but does not include any conviction for which the <br />records have been ordered expunged or sealed. <br />E If a person is convicted of one (1) or more of the offenses <br />descnbed in Subsection C after the person's election or appointment to the office <br />of Mayor or Councilmember, the office shall be declared vacant effective on the <br />date of the conviction. <br />F. No City employee, and no City board or commission member, may <br />serve as Mayor or Councilmember A City employee or a City board or <br />commission member who is elected as Mayor or Councilmember shall be deemed <br />to have resigned from the position of City employee, or City board or commission <br />member, on the date of taking office under subsection 2.02.040(B) <br />G. No person may be a candidate for both Mayor and Councilmember <br />at the same election, or hold both positions simultaneously. <br />H. The Mayor and each Councilmember shall continue to meet the <br />requirements of this section throughout the term of office. <br />Sec. 2.02.040 — Terms — oath — time of taking office. <br />A. Each Councilmember shall be elected for a four (4) year term <br />Councilmembers' terms shall be staggered within each ward. The Mayor shall be <br />elected for a four (4) year term <br />B The Mayor and each Councilmember shall take office at the first <br />regular meeting of the Council following their election, and shall continue in <br />office until their successors have been elected and take office, or a vacancy is <br />earlier established <br />C Before taking office, the Mayor and each Councilmember shall <br />take and file with the City Clerk an oath or affirmation to support the Umted <br />States Constitution, the State Constitution, the Charter, and the ordinances of the <br />City, and to faithfully perform the duties of the office. <br />Sec. 2.02.050 — Vacancies. <br />A A vacancy shall exist if, during the term of office, the Mayor or a <br />Councilmember dies, is judicially declared incompetent, resigns, is recalled <br />without the election of a successor, no longer meets one (1) or more of the <br />qualifications specified in Section 2.02.030, or has had more than six (6) absences <br />from regular Council meetings during any period of twelve (12) consecutive <br />calendar months.
