Louisville Local Licensing Authority <br />Meeting Date: July 29, 2002 <br />.Page 4 of 5 <br /> <br />happened, which is not unusual in this type of setting because of the varying <br />responsibilities of the bartenders. <br /> <br />Member Wilson inquired about where the burden of proof would fall if the <br />Authority went forward with action regarding this incident. Attorney Harrington <br />explained the Authority would hire a prosecutor to present the case with enough <br />evidence to show that an establishment is in violation. The licensee also has a <br />responsibility to show cause why their license should not be suspended or <br />revoked. Ultimately the responsibility lies with the City to produce enough <br />evidence that a violation occurred. <br /> <br />The Authority determined that there was not enough evidence to go forward with <br />a Show Cause,.Hearing. <br /> <br />Detective Lanphere noted that Druids Arms is continually, almost on a monthly <br />basis, having incidents. This may be something the Authority will have to <br />address in the future. He suggested providing.the establishment with more <br />training. <br /> <br />Member Kimmett suggested that Deputy Schmidt put together a compilation of <br />incident reports since the first of the year. Deputy Schmidt replied that she did <br />research any violations that had occurred in the past year that produced a Show <br />Cause Hearing. No further action was taken. <br /> <br />Member Wilson suggested that incident reports that only involve theft or are extremely <br />benign be moved to the consent agenda and if the Authority feels something merits <br />more discussion that an item can be removed from the consent agenda and placed on <br />the police department report agenda. Member Sackett inquired as to what would <br />constitute a minor incident. <br /> <br />Chairperson Lipton noted that the consent agenda is a routine action. Attorney <br />Harrington agreed and stated that police reports are listed under the police department <br />because there may or may not be action taken as a result of them. The Authority' <br />thought it would not save much more time if minor incident reports were moved to the <br />consent agenda.
