RESOLUTION NO. 36 <br />SERIES 2018 <br />A RESOLUTION APPROVING A RENEWAL AND AMENDMENT TO AN <br />INTERGOVERNMENTAL AGREEMENT WITH BOULDER COUNTY FOR <br />HAZARDOUS MATERIALS MANAGEMENT <br />WHEREAS, Boulder County has implemented a hazardous materials management program <br />to provide a safe, convenient place where residents and businesses of Boulder County can dispose <br />of hazardous wastes and to provide for the safe and environmentally sound recycling and disposal <br />of hazardous materials; and <br />WHEREAS, there has been proposed between Boulder County and Louisville, Broomfield, <br />Boulder, Erie, Lafayette, Longmont, Superior an intergovernmental agreement (the "Agreement") <br />for the funding of the hazardous materials management program and for the operation of the <br />hazardous materials management facility located in Boulder; and <br />WHEREAS, the parties are authorized to enter into this Agreement pursuant to their <br />respective charters, ordinances and state law, including but not limited to C.R.S. § 29-1-203, and the <br />City Council by this Resolution desires to approve said Agreement and authorize its execution; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1. The proposed Intergovernmental Agreement for Hazardous Materials Management <br />between the City of Louisville and the County of Boulder (the "IGA") is hereby approved in <br />essentially the same form as the copy of such IGA accompanying this Resolution. <br />2. The Mayor is authorized to execute the IGA on behalf of the City, except that the <br />Mayor is hereby further granted authority to negotiate and approve such revisions to said IGA as the <br />Mayor determines are necessary or desirable for the protection of the City, so long as the essential <br />terms and conditions of the IGA are. not altered. <br />3. The Mayor, City Manager, Director of Public Works and City staff are hereby <br />authorized to execute all documents and do all other things necessary on behalf of the City to <br />perform the obligations of the City under the IGA. <br />PASSED AND ADOPTED this 21 sr day of August, 2018. <br />Robert P.
