City Council Legal Review Committee <br />March 8, 2018 <br />Page 2 of 2 <br />Members decided to ask the full Council if they endorse the Committee working <br />on the evaluation plan and asking of there are any other topics they feel the <br />Committee should look into. <br />MUNICIPAL COURT UPDATE <br />JUDGE WHEELER <br />Judge Wheeler reported on how it is going in the Court. She noted new <br />legislation will require the Court provide representation more often. <br />Councilmember Loo asked how often and how much should be budgeted. <br />Wheeler stated it will not be needed very often as we can generally give the <br />person a personal recognizance bond. <br />Light stated the City can put out an RFP or RFQ to find attorneys that can be on <br />call for work in the Court. Muth noted payments for this can be put in upcoming <br />budgets. <br />Wheeler stated she and other Boulder County judges have discussed the <br />possibility of an intergovernmental agreement that would allow other municipal <br />court to hold bond hearings if it is easier and more timely than transporting <br />defendants to other locations. <br />Councilmember Leh asked if Wheeler knew of any City ordinances that need to <br />be updated to help the court processes. Wheeler asked if the speeding in school <br />zones language could be clarified if it is an increase in fine or a doubling of the <br />fine. <br />PROSECUTOR CRIBARI <br />Cribari reported on how it is going in the Court. She stated there have been a lot <br />of changes recently on the sealing of records. She discussed how the court <br />handles a minor in possession ticket and how it works with kids to make it a <br />learning experience for them. <br />She stated there will be an update of the model traffic code sooner than later and <br />that may require the Council to update some ordinances. She discussed her <br />philosophy on how she assigns traffic classes to defendants. <br />LAWSUIT SETTLEMENTS/LITIGATION UPDATES <br />No report. <br />DISCUSSION ITEMS FOR NEXT MEETING <br />To be determined. <br />ADJOURN <br />The meeting adjourned at 5:55 pm. <br />
