MoMs: <br /> <br />The Authority previously set the boundaries of the neighborhood <br />for the license as the current boundaries of the City of Louisville. <br /> <br />Does anyone present object to the boundaries of the neighborhood <br />being the current boundaries of the City of Louisville? <br /> <br />If not, we will proceed with the Hearing. <br /> <br />NONE <br /> <br />Morris: <br /> <br />I move that the complete application be made a part of the record <br />of this hearing. Is there a second? <br /> <br />Jeffers: <br /> <br />I'll second that motion. <br /> <br />Morris: <br /> <br />Does anyone present object to the motion? <br /> <br />NONE <br /> <br />Morris: <br /> <br />If not, the motion is adopted. <br /> <br />The Authority Attorney has a few comments. <br /> <br />Ross: <br /> <br />In considering the application filed by Kaddy Shack Restaurant, the <br />Authority is acting in a quasi-judicial capacity. The Authority's <br />decision must be based on the evidence presented to it at the <br />hearing tonight and the legal requirements set out in state laws. <br />Under state law, you must consider the character of the applicant, <br />the reasonable requirements of the neighborhood for this type of <br />license, the desires of the adult inhabitants of the neighborhood, <br />and the number, type, and availability of other similar outlets in the <br />neighborhood. <br /> <br />Mo~s: <br /> <br />Will the applicant please come forward, state your name and <br />address for the record, and take the oath. <br /> <br />Salas: <br /> <br />Do you solemnly swear or affirm under penalty of perjury that the <br />testimony you are about to give will be the truth, the whole truth, <br />and nothing but the truth? <br /> <br />2 <br /> <br /> <br />
