Local Licensing Authority <br />Minutes <br />September 23, 2019 <br />Page8of8 <br />Machado noted he appreciates what Mr. Walsh does to prevent over service but <br />found the bartender's statement as reported in the police report problematic. <br />Kaufman wondered if the bartender should have further engaged this patron to <br />determine if he was intoxicated. <br />MOTION: Brown moved sufficient evidence had been presented to support the <br />charges stated in the Show Cause Order concerning a visibly intoxicated person <br />and that the Authority Attorney be directed to prepare a draft of final findings, <br />conclusions and an order for consideration at the Authority's next meeting to be <br />held on October 28, 2019 and further moved to continue this matter until that <br />time. Kaufman seconded. Roll Call Vote: Brown — yes, Kaufman — yes, <br />Machado — yes. <br />Mr. Gollin recommended the penalty be 3 days suspension with 2 days held in <br />abeyance and the ability to pay a fine in lieu for 1 day. <br />Machado moved to accept the recommendation for 3 day suspension, 2 days <br />held in abeyance and allow a fine in lieu for the 1 day figured at 20% of liquor <br />sales, no less than $200 and no more than $5000, on October 5, 2019 and report <br />and pay the fine by October 21, 2019. Kaufman seconded. All in favor. <br />Members discussed the fine in lieu and determined Mr. Walsh could report his <br />information to the Authority Secretary and have her figure the fine and accept it <br />from Mr. Walsh. <br />Police Department Reports <br />No reports. <br />Secretary's Report <br />No report. <br />Authority Attorney's Report <br />No report. <br />Authority Comment <br />Adjourn — Machado moved to adjourn.
