I THE CITY OF LOUISVILLE JANUARY 28, 1998 REGULAR LOCAL LICENSING AUTHORITY MEETING Local Licensing Authority of the City of Louisville met in a regular session on January 28, 1998, in the 2nd Floor Council Chambers, City Hall, 749 Main Street, Louisville, Colorado. Chairperson Gene Morris called the meeting to order at 7:00 p.m. and the following persons were present. ROLL CALL Attendance: Jerry Riggins, Gene Morris, Steve Jeff.ers, Marguerite Lipton, Bill Kimmett and Shefi Budner Marsella Also Attending: Sam Light, Kathleen Kellley, Griffiths & Tanoue, P.C. Heather Balser, Acting Secretary to the Authority Absent: Larry Evans (excused) APPROVAL OF AGENDA Gene Morris called for any Authority comments or motion. Question on the renewal license for Kaddy Shack with regards to the expiration of the lease. As to the issue of the expiration of the lease, the State regulations require that the licensee have possession of the license premises throughout the term of the license. The license expires three weeks before the renewed term. They do not have to provide proof of possession in order to obtain a renewal, however, if they do not have the lease renewal prior to January 31, 1999, they will be in violation of State law and could be subject to revocation. The Authority can approve the renewal, however, within eleven months, if they do not have the renewal of the lease, the Authority can revoke their license. The Authority directed the Secretary to prepare a letter to submit with the renewal, stating the provisions that the lease is to be provided prior to January 31, 1999 or the license will be revoked.
