Subsequent to the subdivision, Lot 1 was divided into <br /> two 3500 sf lots by foreclosure proceedings against the deed of <br /> trust. <br /> The following language has been drafted by the City Attorney and <br /> becomes staff 's guideline for the review of any future develop- <br /> ment requests on subject property (Lot 1) : <br /> Lot 1 of the Stewart Subdivision was divided by foreclosure of a <br /> deed of trust on a portion of the Lot . Section 16. 04. 040. B <br /> provides that th6''subdivision regulations of the City of Louis- <br /> , ville contained in Title 16 of the City Code do not apply to <br /> various divisions of land, including any division of land by the <br /> foreclosure of a deed of trust. Such a foreclosure would not, of <br /> course, exempt the divided land from other requirements of the <br /> City Code not contained in- the Title 16 subdivision regulations. <br /> Although the action is recognized as a legitimate exception by <br /> Section 16. 04. 040 B. 4. of the Louisville Code the result of the <br /> action has; 1) created two owners for Lot 1, and 2) divided Lot 1 <br /> into two nonconforming lots with respect to minimum lot area. <br /> et5cer _y,c,.. .)0.c.,.: <br /> / • <br /> Paul S.
