<br />The proposal does not include public or private trail connections on the site. Due <br />to security concerns of the tenant, no public access is proposed beyond the main <br />pedestrian access off the front property line. There is a possibility for public <br />access that traverses the site connecting development on the east to other trail <br />connections to the north, south or west that does not access the buildings on this <br />property. The configuration of the easement could be revised to accommodate <br />public trail connections, if desired. <br /> <br />Analysis <br />Sec. 17.28.080 of the Louisville Municipal Code gives the City the authority to <br />require additional open space as part of a PUD app lication. The requirement for <br />additional open space is based on the following factors: <br /> <br />1. Comprehensive development plan; <br />2. Topography, drainage, vegetation or other such physical conditions; <br />3. Anticipated socio-economic conditions; <br />4. Type and density of development and employment; <br />5. Overall need for open space and recreational facilities. <br /> <br />Land set aside as open space under the above provisions may be owned and <br />maintained by the developer, or may be dedicated to the City. <br /> <br />Staff believes that additional open space is appropriate based on comprehensive <br />plan policy and the type and density of development and employment. The <br />comprehensive plan policy for this property allows height above three stories if <br />structures are clustered and located out of the public view shed and buffered by <br />surrounding topography and Open Space. Additionally, the City has entered into <br />Intergovernmental Agreements (IGA) with neighboring jurisdictions that limit <br />Easement <br />location
