NONE <br /> <br />Davidson closed the public hearing and called for Council comments. <br /> <br />Howard stated that as long as the City provides reasonable access to the telecommunication industry, <br />the City is not in violation of the law. <br /> <br />Mayer requested that the City Attomey review the ordinance and make confidential recommendations <br />to Council about her view on the communications act. <br /> <br />Howard moved that Council approve Ordinance No. 1264, Series 1997, on first reading and set <br />second reading for August 19 with another public hearing, seconded by Mayer. All in favor. <br /> <br />APPEAL COLONY SQUARE OF PLANNING COMMISSION DENIAL OF <br />PRELIMINARY SUBDIVISION PLAT AND PUD DEVELOPMENT PLAN (CONTINUED <br />FROM 7/15/97) <br /> <br />Paul Wood, Planning Director, stated that on June 10 Planning Commission conducted a public <br />hearing on the Colony Square Preliminary Subdivision Replat and PUD Development Plan for Lots <br />1 thru 4. The Commission passed by a vote of 4 - 0 Resolution No. 22, Series 1997, disapproving <br />the proposed preliminary subdivision replat and PUD development plan. The issues related to the <br />Comfort Inn view corridor and parking. The Council may approve as was submitted, approve with <br />modifications, or deny the preliminary plat and shall make explicit its findings if different from those <br />of the Planning Commission. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />Dan Blankenship, SEM Architects, 7935 East Prentiss, Suite 102, Englewood, Colorado 80111, <br />stated that they were asking for approval of the Preliminary Development Plan and Preliminary <br />Subdivision Plat so they may move into the Final PUD and Development Plan process. He stated that <br />the five major issues were parking, existence of a drive through Burger King with a Grease Monkey, <br />off-site storm drainage/detention in the public open space, the existence of excessive curb cuts and <br />their poor alignment, and the basic lack of architectural design on the building (rear and sides). Ail <br />of which had been affirmatively addressed. He pointed out that there is no Burger King or drive-thru <br />and no Grease Monkey. Parking is more than required. There are two curb cuts on each side aligned <br />to each other. Architecturally, the buildings will blend with surrounding buildings. Open space will <br />be at 30% and will meet both the Gateway and Commercial Design Guidelines. <br /> <br />Davidson called for public comments. <br /> <br />Rudy Rudolph, 1196 Dillon Road, Louisville, Colorado, one of the owners of the Comfort Inn in <br />Louisville, stated that one of their concerns is the visibility issue.
