RESOLUTION NO.60 <br />SERIES 2020 <br />A RESOLUTION APPROVING AN INTERGOVERNMENTAL CONTRACT WITH <br />THE STATE OF COLORADO FOR STORM WATER QUALITY MASTER PLAN AND <br />CAPITAL IMPROVEMENT PLAN IMPROVEMENTS <br />WHEREAS, the City of Louisville ("City") and the State of Colorado Department of <br />Public Health and Environment ("State") desire to modify the stormwater master plan and design <br />two (2) priority stormwater capital improvement projects for the City to evaluate current <br />stormwater infrastructure and future necessary stormwater capital projects. The stormwater <br />master plan will be used to pursue funding for construction in problem locations determined in <br />the plan to improve water quality for the residents of the City. Improving water quality within <br />the State has direct positive environmental benefits for aquatic ecosystems and human health <br />benefits; and <br />WHEREAS, an agreement has been proposed between the City and the State setting <br />forth the rights and obligations of the City and State with respect to the identification, design and <br />construction of storm water quality improvements for the City's stormwater infrastructure <br />("Agreement"); and <br />WHEREAS, the City Council finds that the proposed Agreement is in the best interests of <br />the City and its citizens; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF LOUISVILLE, COLORADO: <br />1. The City Council hereby approves the proposed Intergovernmental Contract <br />between the City of Louisville and the State of Colorado for the benefit and use of the Department <br />of Public Health and Environment, for the identification, design, and construction of stormwater <br />infrastructure improvements ("Agreement"), in essentially the same form as the copy of such <br />Agreement accompanying this Resolution. <br />2. The Mayor is authorized to execute the Agreement on behalf of the City, except that <br />the Mayor is hereby further granted authority to negotiate and approve such revisions to said <br />Agreement as the Mayor determines are necessary or desirable for the protection of the City, so long <br />as the essential terms and conditions of the Agreement are not altered. <br />3. The Mayor, City Manager, Director of Public Works and City staff are hereby <br />authorized to execute all documents and do all other things necessary on behalf of the City to <br />perform the obligations of the City under the Agreement. <br />PASSED AND ADOPTED this 18th day of August, 2020. <br />Resolution No. 60, Series 2020 <br />Page 1 of 2 <br />
