Louisville Local Licensing Authority <br />Meeting Date: October 29, 2001 <br /> <br />made. Carney stated that the licensee has taken action and produced strict policies and procedure <br />guidelines for their staff. Attorney Carney stated that in addition to the material provided to the <br />Authority, a copy of the Colorado Liquor and Beer Codes and City of Louisville ordinance <br />pertaining to alcoholic beverages has also been added to their manual. Carney stated that the <br />owners have met with each employee, reviewed the guidelines, and had each employee sign-off that <br />they have read and understand its contents. <br /> <br />Carney reiterated that this is the first time there has been a problem at Pine Street Junction in three <br />years, and that the owners are committed to serving the citizens of Louisville in a professional and <br />responsible manner. <br /> <br />Attorney Carney responded to several items outlined by Attorney Barnett. Carney stated that there <br />was a need to improve communication between staff and management, and that if good <br />communication had existed the evening of August 17th, the first event would have been reported and <br />would not have been brought before the Authority. Attorney Carney stated that the penalties <br />contained in the Stipulation and Agreement are severe, though not unreasonable, and that there is a <br />great deal of incentive for the licensee by having five days held in abeyance. <br /> <br />Attorney Carney requested permission to read a letter from Mr. Daniel McRae, a regular customer at <br />Pine Street Junction. Chairperson Lipton granted the request and Attorney Carney read the letter <br />into the record and distributed copies to the Authority. Attorney Carney added that three additional <br />patrons of Pine Street Junction have also written letters of support and are present at the meeting to <br />offer testimony. <br /> <br />Member Jeffers stated that since the proceeding is not a hearing, he did not want to hear any witness <br />testimony. Chairperson Lipton concurred. <br /> <br />Attorney Carney stated that the two staff members that served the individuals involved in the <br />second event on the evening of August 17, 2001 are also present to offer testimony. <br /> <br />Attorney Carney stated that Mr. D'onofrio can answer any Authority questions concerning the May <br />incident and that Mr. Maes can answer any questions concerning the August incident. <br /> <br />In lieu of their testimony, Attorney Carney summarized the events of August 17, 2001. He stated <br />that Mr. Maes was the manager on duty August 17, 2001, and was downstairs cleaning when the first <br />event occurred inside the establishment. Carney stated that when Mr. Maes came upstairs, it was <br />obvious to him that the bar was being cleared out. Attorney Carney offered that it is the policy of <br />Pine Street Junction to encourage patrons to leave the bar after last call, and that Mr. Maes thought <br />that was the reason staff was clearing people out, although he thought the situation seemed to be a <br />little more tense than usual. Carney stated that once Mr. Maes got outside, the female patron who <br />had been hit earlier in the evening stated to him that her car had been broken into at which time Mr. <br />Maes contacted the police. <br /> <br />Attorney Carney stated that Mr. Maes did not inform the police of the fight that had occurred <br />because he didn't know about it.
