WHEREAS, for such purposes, the parties desire to amend the Subdivision Agreement <br />as set forth herein. <br />NOW, THEREFORE, in consideration of the foregoing, the parties hereto promise, <br />covenant and agree as follows: <br />Section 1. The last sentence of the first paragraph of Section 1.6 of the Subdivision <br />Agreement is hereby amended to read as follows (additions are shown in underline and deletions <br />are shown st-r-ikee ): <br />"In addition to the restrictions set forth in this Agreement, no more than five-(5) <br />twelve (12) certificates of occupancy shall be issued for the Subdivision by the <br />Building Division prior to the City's issuance of Construction Acceptance of the <br />Subdivider Improvements (as evidenced by a letter issued by the Public Works <br />Department) and the City's determination that Subdivider Improvements have <br />been completed in compliance with the Plan (as evidenced by a writing issued by <br />the Planning Department). <br />Section 2. The last paragraph of Section 1.6 of the Subdivision Agreement is hereby <br />amended to read as follows (additions are shown in underline and deletions are shown sheet): <br />WWI <br />"III lip" <br />Section 3. Except as expressly amended in this Amendment, the Subdivision <br />Agreement remains in full force and effect. <br />Section 4. This Amendment may be executed in one or more counterparts, and when <br />all counterparts are so signed, the sum of them shall be considered the original and shall be <br />deemed to have been signed as one integrated document. <br />2 <br />
