Ansel Garett <br />Mr. Degenhart was concerned about what assurance do we have, if another variance <br />was granted that it would 'oe met. <br />.Murphy suggested a deferred prosecution to guarantee compliance. <br />Mr. Davies wanted to know how a second variance could be issued, if the first <br />variance had not been complied with? Mr. Ross stated that Mr. Garrett had made an <br />attempt to comply. The top rail is still there, but it was left there, to see the <br />outcome of this hearing, then it would be decided what to do. <br />Mr. Murphy said that all that has to be done is cut off the pickets, put them back <br />up, and adjust the top rail to hold them. <br />Mr. Pickett referring to the first variance. The variance granted reads 4ft back <br />from sidewalk, which is 42 inches high to 6ft high. Forty-two inches is not high <br />enough to protect against vicious dogs. If we talk about a symetrical fence the <br />variance must read lift west of west side of the sidewalk, and cover the first 25 ft. <br />of the fence. <br />The variance as repeated by Mr. Murphy. To permit the construction of a solid <br />fence on the norht side of 411 County Road, beginning It ft. west of west side of <br />sidewalk and extending the full depth of the lot, and to be a rnaxium of 6 ft. high. <br />Said fence to comply no later than,January 31, 1975.
