City Council <br />Meeting Minutes <br />December 15, 2020 <br />Page 3 of 8 <br />REVIEW USE TO ALLOW USE GROUP #35, OUTDOOR EATING AND DRINKING <br />ESTABLISHMENTS FOR MOXIE BREAD COMPANY AT 641 MAIN STREET <br />Mayor Stolzmann introduced the item and asked for any disclosures. There were no <br />disclosures. Mayor Stolzmann opened the public hearing. <br />Clerk Muth noted there were some comments submitted regarding this application but <br />due to computer issues staff was unable to post them to the website which is the normal <br />practice. <br />Councilmember Leh read one email from Mike Deborski that come in late in the day. <br />Deborski asked Council to consider including regulations on where delivery trucks could <br />park as a part of the approval process. <br />Planner Ritchie stated this is a request for a Planned Unit Development (PUD) to allow <br />construction of an addition on the existing structure and a Special Review Use (SRU) to <br />allow outdoor eating and drinking on the site. She reviewed the current site and the <br />proposed changes which include an addition, a roof top deck, and one live -work unit. <br />Ritchie stated staff finds the application meets all the criteria and noted the SRU does not <br />allow amplified music although the applicant does plan to have acoustic music during <br />hours of operation. <br />Staff recommends approval of Resolution 100, Series 2020 with the following conditions: <br />1. Prior to issuance of a building permit, the applicant shall receive approval of the final <br />utility design from public works. 2. Prior to recordation of the PUD and SRU, the applicant <br />shall receive approval of a license agreement with the City to accommodate the <br />encroachments in the right-of-way. <br />Andy Clark, applicant, stated this expansion is needed to enlarge the kitchen and help <br />expand his business. <br />Public Comments <br />Mark Oberholzer, 224 South Hoover, stated he supports the expansion to help make that <br />building useful and to help a local business expand. <br />Councilmember Brown asked if this building was eligible for landmarking. Ritchie stated <br />the property owner is not applying for landmarking at this time however staff does not feel <br />this addition would preclude the owner from applying for landmark status in the future. <br />Councilmember Brown asked if parking had been evaluated. Ritchie stated staff has <br />reviewed the parking and this application does not have enough new development to <br />require additional parking other than the one parking space provided. <br />
