approval of the Proposed 1041 Amendments to the City Council; and <br /> <br /> WHEREAS, at the Public Hearing on November 17, 1998 to review the Proposed 1041 <br />Amendments, the City Council considered the recommendation of the Planning Commission, the <br />testimony of the City Planning Department staff, City Attorney, and several members of the public, <br />all of which documents and testimony are hereby incorporated into the record of the Public Hearing <br />and into this Ordinance by this reference; and <br /> <br /> WHEREAS, at the Public Hearing, the City Council determined that it was appropriate to <br />designate the additional areas and activities addressed in the Proposed 1041 Amendments, as areas <br />and activities of state interest tobe regulated under House Bill 1041 within the City, pursuant to the <br />criteria for designation set forth in House Bill 1041 and in the Model Regulations of the Colorado <br />Land Use Commission (hereafter, "the Model Regulations" and "the CLUC"); and <br /> <br /> WHEREAS, the City Council thus finds that the Proposed 1041 Amendments, as presented <br />to and considered by the City Council in this Ordinance are appropriate and necessary for adoption <br />to govern the administration of the additional designated areas and activities addressed in the <br />Proposed 1041 Amendments, all for the following reasons, and as supported by the recommendation <br />of the City Planning Commission dated November 10, 1998 and by the record of the Public Hearing: <br /> <br />1. There exists an intensity of current and foreseeable development pressures within the <br />City of Louisville and adjacent communities which warrants the City's regulation of the <br />additional areas and activities addressed in the Proposed 1041 Amendments which may be <br />located in whole or in part within the City; <br /> <br />2. Current and foreseeable growth pressures within Louisville and adjacent communities <br />are considerable, and are engendering the need or desire for additional highway and urban <br />development. These developments, in turn, may have a major impact on growth patterns <br />within the City, with potential adverse impacts on the rural or "small town" character of the <br />City and impairment of the goals and policies of the City of Louisville Comprehensive Plan; <br /> <br />3. Highway and new urban development, when located within areas affecting the City, <br />frequently have major environmental and aesthetic, as well as growth-related, impacts, which <br />have the potential to adversely influence the rural and small town character of the City. <br />Without the authority provided through the Proposed 1041 Amendments, the City has limited <br />ability to have binding regulatory control over these developments and their impacts; <br /> <br />4. The foregoing concerns indicate a need for improved, coordinated review of the <br />additional areas and activities addressed in the Proposed 1041 Regulations, by providing a <br />City-wide evaluation of the following issues: (a) the impacts of the additional designated <br />areas and activities of development within them on public facilities, view corridors, the rural <br />or "small town" character of Louisville, and the agricultural, open space and other land and <br />environmental resources of the City; (b) the financial and growth consequences associated <br />with the additional designated activities; (c) the efficiency of the additional designated <br /> <br /> <br />
