City of Lafayette: From Coal Creek Trail to SH 42 <br />City of Louisville: From to SH 42 to south of NW Pkwy vehicle bridge <br />Boulder County: From south of NW parkway vehicle bridge to Rock <br />Creek Trail <br />A. Trail corridor maintenance shall follow the maintenance standards of the agency <br />responsible for the trail section and shall include: <br />1. Mowing the trail corridor. <br />2. Weed control of noxious and nuisance plants. If local agency herbicide <br />restrictions do not allow for successful control of state listed noxious weeds, <br />then Boulder County shall assist with weed control efforts. <br />3. Reconditioning or minor resurfacing of the trail as needed. <br />4. Drainage upkeep including cleaning culverts, concrete pans, and maintaining <br />cross slope. <br />5. Removal of trash and debris along trail corridor. <br />6. Removal of hazard limbs and trees. <br />7. In general this regional trail will only be snow -plowed on hard surfaces to <br />remove major blockages or obstructions resulting from road plowing. <br />B. Maintenance access for the entire trail corridor is permitted for day-to-day maintenance <br />activity. <br />C. Contractor access, trail closures, and race/public events with participation greater than <br />twenty five individuals are subject to review and approval by all the Parties. <br />D. Shall future amenities be desired, the location, standards, procurement and maintenance <br />of those amenities should be mutually agreed upon by the Parties. <br />8. Capital Maintenance Costs. For the purpose of the Agreement, capital maintenance cost <br />are defined as costs at or exceeding $5,000. These costs shall be shared by the Parties <br />consistent with the Open Space property ownership Intergovernmental Agreement, with <br />a 33%/33%/33% split among the Parties. Funds shall be requested a year in advance for <br />budgeting planning purposes. <br />9. Trail Use Reaulations and Non -Motorized Bicvcle and Pedestrian Public Access. The Parties <br />agree that the Connector Trail will be open to the public for bicycle and pedestrian use. <br />Equestrian and electrical assisted bicycle or "e-bike" use will be determined by each Party <br />within the area under their management control, and agreed upon by the Parties. The <br />Connector Trail shall be open 24 hours a day, 7 days a week. The County shall have authority <br />to enforce the Rules and Regulations for Parks & Open Space Areas in areas of the corridor for <br />the Connector Trail in unincorporated Boulder County. Louisville and Lafayette shall have <br />authority to provide regulatory enforcement pursuant to the ordinances of those cities. <br />10. Hold Harmless Responsibilities. The Parties are responsible for their own acts and agree to <br />hold the other Parties harmless for their acts. <br />11. Compliance with Grant Requirements. The Parties agree to comply with the applicable <br />provisions of the Grant, which is attached hereto as Exhibit C. <br />A. ENTIRE AGREEMENT: AMENDMENTS. This Agreement contains the entire <br />agreement between the Parties related to the Connector Trail.
