<br />TO: <br />FROM: <br />DATE: <br /> <br />COUNCIL COMMUNICATION <br />MAYOR AND CITY COUNCIL <br />MALCOLM FLEMING, CITY MANAGER <br />MAY 26, 2009 <br />UPDATE/DISCUSSION BOARD OF ADJUSTMENT <br /> <br />SUBJECT: <br /> <br />ORIGINATING DEPARTMENT: PLANNING DEPARTMENT ON BEHALF OF THE BOA <br /> <br />INTRODUCTION: <br />The Board of Adjustment (BOA) is a six member quasi-judicial board that hears and decides <br />requests for variances from the City's zoning ordinance. It also hears and decides floodplain <br />development permits and appeals of administrative zoning and floodplain decisions. <br /> <br />BOARD MEMBERS: <br />The current board members are: Wayne Chancellor, Chair; Gunnar Malmquist, Vice-chair; <br />Horst Loeblich, James Stuart and John Weise. Erik Jasiak is the associate member. One (1) <br />regular position is open on the board. <br /> <br />2008 SUMMARY: <br />The BOA heard seven (7) variance requests in 2008. The majority of the requested variances <br />(5 out of 7) dealt with properties in the Old Town Overlay District, while the remaining two (2) <br />were for Flood Plain Development Permits outside of the overlay district. <br /> <br />Of the seven (7) cases heard, only one (1) case was denied.
